Man o’ War Boulevard, Lexington’s southern beltway, appears three times in the list of the top 10 most dangerous intersections in Lexington. There is nothing surprising about that, however, since outside of the Interstate highways, Man o’ War probably sees more traffic than any other road, and it one of the longest roads in town.
Richmond Road is part of US Highway 25, which runs nearly 200 miles. It is a major Lexington thoroughfare that hosts several large shopping centers in the vicinity of its intersection with Man o’ War Boulevard, many of which serve alcohol. This intersection saw 26 car accidents in 2017. In December 2018, a truck carrying two cars overturned, shutting down the eastbound lanes of Man o’ War Boulevard for two hours.
How No-Fault Auto Insurance Works
Kentucky is one of a dozen or so “no fault” auto insurance states. What this means is that unless your injuries are serious, you pay for your own injuries with your no-fault (PIP) insurance. You cannot sue the other driver without escaping the no-fault system, which you can usually do if you suffered an injury that is sufficiently serious to justify looking beyond your own insurance coverage for compensation.
If Someone is Killed in the Accident
If someone is killed in the accident, a different set of rules applies — Kentucky wrongful death law. Whoever would be liable if the victim had been merely injured will probably be held liable in a wrongful death lawsuit.
A Kentucky wrongful death claim must be filed by the personal representative (executor) of the victim’s estate, who is named by the probate court. Damages, however, go partly to the victim’s probate estate (for eventual distribution to the victim’s heirs) and partly to surviving family members (for emotional distress and loss of financial support). The amount of damages awarded in a wrongful death claim can be quite substantial.
